Welcome to the Argus service (the “Service”, as defined below). We hope you will have a great experience using our monitoring, observability, and incident-detection services. Please review these Terms of Service thoroughly before commencing use of our Service.
In these Terms of Service, “Argus” means Argus, Inc., with offices at Whitefield, Bangalore, Karnataka – 560066, India (hereinafter, “Argus” or the “Company”). We provide such services to you subject to the following conditions. Before you may use the Service, you must read and accept all of the terms and conditions in, and linked to, these Terms of Service (“TOS” or “Terms”) and the linked Privacy Policy, which are incorporated into and made part of these Terms. If the TOS conflict with any other documents or agreements, the TOS will control for the purposes of usage of the Service. If you do not agree to be bound by these TOS and the Privacy Policy, you may not use the Service in any way.
These Terms constitute an electronic contract between you and Argus. By accessing or using the Service, you indicate your unconditional acceptance of these Terms. Please review these Terms carefully, including the arbitration provision, which describes how disputes will be resolved. We reserve the right, in our sole discretion, to update or revise these Terms of Service. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
Argus provides users with access to monitoring and observability services including, but not limited to, agent-driven telemetry collection, real-time metrics, logs and traces, anomaly detection, and incident alerting. Collectively, all of these services are referred to in these TOS as the “Service” or “Services”.
Argus grants you a limited license to access and make personal or organizational use of the Service. You may not use the Service for any unlawful purpose or for activities that infringe on the rights of Argus or others. Unauthorized use terminates the license granted by Argus.
Users must be 18 years or older (or 16 years with consent where permitted) to register. By using the Service, you represent that you meet these requirements and have not been previously barred from the Service.
You are solely responsible for the telemetry and content you transmit through the Service. By submitting data, you grant Argus a limited license to process such data solely to provide the Service. You retain ownership of your data, and Argus will not use it for any purpose other than delivering and improving the Service.
You agree to comply with all applicable laws, regulations, and industry standards, including but not limited to data protection, cybersecurity, and export control requirements. Argus makes no guarantees that use of the Service ensures compliance with any laws or regulations applicable to you.
All content, software, and materials provided by Argus are the property of Argus or its licensors and are protected by intellectual property laws. You may not copy, distribute, or create derivative works without prior written consent.
The Service is provided “as is” and “as available.” Argus disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Argus shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from use of the Service. Liability shall not exceed the greater of the amount you paid for the Service in the preceding twelve months.
Argus may suspend or terminate your access to the Service at its sole discretion. Upon termination, all rights and licenses granted to you will cease immediately.
Any disputes will be resolved by binding arbitration in Bangalore, Karnataka, India, under applicable arbitration rules. These Terms shall be governed by the laws of India, without regard to conflict of law principles. You waive any right to a jury trial or class action.
